The electronic patient file – What to do with physical patient files?

As of January 15, 2025, all health insurance companies are required to create an electronic file (ePA) for their insured members. The use of the electronic patient file (ePA) is free of charge for insured individuals. Those who do not wish to have an ePA must actively opt out.

  • But what happens to the physical patient files if the patient decides to use the ePA?

Currently, there is no clear legal regulation that allows for the destruction of scanned medical documents. The act of "substitute scanning" does not override the legal retention period for physical documents. Therefore, in many cases, the physical file must still be kept, particularly with regard to the opt-out option for patients, i.e., those who reject the ePA. It is also important to note that the ePA can be revoked by the insured at any time after it has been established.
